MOFCOM and SASAC Jointly Held the Forum on Intellectual Property Protection and Innovative Development of Central
On September 27, General Office of Leading Group for National Cracking down on IPR Infringement and Counterfeit and Shoddy Goods and State-owned Assets Supervision and Administration Commission under the State Council jointly held the Forum on Intellectual Property Protection and Innovative Development of Central Enterprises themed as “IPR Protection and Core Competitiveness” at Qingyuan, Guangdong. Vice Minister of Commerce of PRC Wang Chao and Deputy Director of the SASAC under the State Council Huang Shuhe delivered keynote speeches respectively.

Wang Chao pointed out in his speech that along with the further development of knowledge-based economy and economic globalization, competition between states mainly represents competition on intellectual property, thus intellectual property protection becomes increasingly important. To encourage the creation and enhancement of competitive advantage of nations by way of strengthening the protection for intellectual property is increasingly becoming the consensus of various nations across the world. As the largest developing country in the world, China has to follow international trends to vigorously strengthen the protection for intellectual property, so as to become a member of of innovation-oriented countries, continuously improve its national competitiveness and achieve scientific development.

Wang Chao said that Chinese government attached great importance to intellectual property and included the protection for intellectual property in the agenda of important issues, and released the Outline of the National Intellectual Property Strategy which defined the guiding concept, basic principles, main contents and major tasks of the medium and long-term protection for intellectual property, deployed and launched the Special Campaign on National Cracking down on IPR Infringement and Counterfeit and Shoddy Goods, and set up the Leading Group for National Cracking down on IPR Infringement and Counterfeit and Shoddy Goods with Vice-premier Wang Qishan as the group head which deployed and launched a series of special rectification programs in such key areas as trademark right, copyright and patent right etc., and vigorously promoted the construction of a long-term and effective mechanism, thus effectively curbing any unlawful act with respect to intellectual property infringement and further elevating the awareness of enterprises and the public with respect to intellectual property protection.

Wang Chao pointed that through unremitting efforts for more than 30 years since the reform and opening-up, China has basically set up an intellectual property laws and regulations system which adapts to the socialism market economy system and is geared to international standards, shaped a law enforcement system with administration and judicature co-existing and multiple parties linked, included in a series of international treaties and conventions on intellectual property protection successively, created a market environment encouraging innovation and investment, and vigorously promoted the comprehensive, balanced and sustainable development of economy and society.

Wang Chao said that to enforce and implement the National Intellectual Property Strategy, it is required to further improve laws, regulations and institution system, launch special rectification programs against prominent problems, create the pattern of intellectual property protection work of mass prevention and control, enhance overseas exchange and cooperation in the field of intellectual property and further enhance efforts to protect intellectual property.

Wang Chao emphasized that enterprises are the core of innovation and intellectual property protection. Central enterprises take a leading role in the construction of socialism with Chinese characteristics and represent the development direction of advanced productive forces as well as the image of China; they are also obliged and able to well accomplish the important mission of intellectual property protection, set examples with respect to innovation advocacy, integrity and good faith, and take the historical responsibility for promoting and improving people’s livelihood, creating a harmonious society and an innovation-oriented country. Central enterprises should voluntarily respect intellectual property of others, strengthen internal management of intellectual property and effectively safeguard their own intellectual property.

Huang Shuhe expressed in the speech that scientific and technological innovation is the fundamental force to break through development bottleneck and win development opportunity; while intellectual property protection is the main method of protecting innovations and win competitive advantages. As an important subject of scientific and technological innovation and use of intellectual property in China, central enterprises shoulder an important mission of constructing an innovation-oriented country and leading the economic development of China. To make great efforts to strengthen work related to intellectual property of central enterprises and achieve the innovation-driven development of central enterprises are the inevitable demand to implement the National Development Strategy and also the inevitable course to increase the core competitiveness of enterprises.

Huang Shuhe said that central enterprises attached great importance to intellectual property related work. During the “11th Five Year Plan”, with their scientific and technological strength increased substantially, central enterprises get a host of innovative results with proprietary intellectual property rights; their patent application quantity and quality as well as rate of implementation have increased substantially in successive years, as at the end of 2011, their own valid patents aggregate to more than 140,000 of which patents for invention account for 28.3%. Meanwhile, the awareness of intellectual property protection and risk prevention obviously are enhanced, as many central enterprises paid more attention to the factor of intellectual property and signed intellectual property agreement in the course of major investment and merger as well as joint venture cooperation with foreign investors, so as to steadfastly resist any infringing and counterfeit goods from flowing into those enterprises. Additionally, central enterprises are also at the forefront of national enterprises with respect to the software legalization related work.

Huang Shuhe pointed out that there were still some weak links in the work of central enterprises concerning intellectual property rights. For example, there are only a few core technologies with proprietary intellectual property rights and not many famous international brands. The capability of transforming the advantage of scientific and technological innovation to market competitive advantage through intellectual property right is not enough. In addition, the ability of self-protection and rights protection is not strong.

Mr. Huang put forward four requirements for the work of central enterprises concerning intellectual property rights: first, to try to play a backbone and leading role in the protection and innovation and development of intellectual property rights; second, to deeply and fully implement enterprises' intellectual property strategies and improve the ability to protect intellectual property rights; third, to propel the transformation from “made in China” to “created in China” and “designed in China” and vigorously cultivate famous brands; fourth, to actively carry out the work to fight against infringement and counterfeiting and the work of software legalization.

Relevant persons in charge of the Trademark Office of the State Administration for Industry & Commerce, the Copyright Administration Department of General Administration of Press and Publication (National Copyright Administration), and the Protection and Coordination Department of State Intellectual Property Office made speeches on the trademark right protection, copyright protection, software legalization by the government and patent right protection respectively, and representatives from four central enterprises made exchanges in the Forum by combining their own practices of creating, utilizing, protecting and managing intellectual property rights.

A total of 260 persons were present at the Forum, including relevant persons in charge of legal and intellectual property right affairs of 117 central enterprises as well as relevant departments of the State Council and representatives of relevant local governments.
